Should ADUs be Sold Separately?

A new state law, AB 1033, grants local agencies the authority to adopt an ordinance allowing for the separate conveyance of an ADU as a condo. Currently, the County and City of San Diego are exploring implementation of this new law. Given that housing production must more than triple for the region to meet our state-mandated goal of 108,000 new units by 2029, could selling ADUs be part of the solution? Proponents believe the new law could:
  • Increase “gentle density” within single-family zoned neighborhoods while maintaining character.
  • Open up a reservoir of reasonably priced homes, given our current median home price is hovering around $1,000,000.
  • Provide a new source of retirement funds for elderly homeowners that want to stay in their existing home, but can no longer afford to.
  • Allows homeowners that do not want to be a landlord to simply sell their ADU.
There are still many issues to be worked out - property taxes, Prop 13 benefits, HOA rules, and more. The good news is type of ordinance is not new; in fact, it is already working in other locations including Seattle, Austin, Portland, and Princeton.

These alerts would include liens recorded and placed on your personal, business, and trust names that you have registered. You can register up to 10 different names or APNs. The County is now offering this service for free!
